This Indenture made the 1st day of June in the year of our
Lord one thousand Eight
Hundred and Forty six Between John Murray of Mount Thom in the County
of Pictou
Farmer of the one part and Alexander Murray of Mount Thom in the County
aforesaid of the other part Witnesseth that the said John Murray for
and in
consideration of the sum of eighty Five pounds of Lawful money of
Novascotia to
him in hand paid by the said Alexander Murray the receipt whereof is
hereby
acknowledged Hath granted bargained sold released alien and confirmed
and by
these presents Doth grant bargain sell release, alien, and confirm unto
the said
Alexander Murray his heirs and assigns all that Lot of Land with the
appurtenances
situate lying at Mount Thom aforesaid as made over to the said John
Murray by will
of his Father angus Murray deceased abutted and bounded as described in
a
Deed from Samuel Archibald of Middle River in the County of Pictou
aforesaid
bearing date the Fifth day of November in the year of our Lord one
Thousand Eight
hundred and thirty one and Registered the first day of February one
Thousand Eight
Hundred and Thirty eight at Pictou containing one Hundered and Fifty
three acres
more or less To Have and To Hold the said Lot of Land with the
Appurtenances to
the said Alexander Murray his heirs and Assigns
to his and their sole use forever -
Provided always and it is the true intent and meaning of the parties to
these
presents that if the said John Murray his heirs Executors,
administrators of Assigns
do and shall well and truly pay or cause to be paid unto the said
Alexander Murray
his Executors Administrtors of Assigns the full principle sum of Eighty
Five Pounds
of lawful money of Novascotia with Interest for the same and after the
rate of six
Pounds per cent per annum on the first day of June in the year of our
lord one
Thousand Eight hundred and Forty eight in manner and form as the same
is
secured to be paid to the said Alexander Murray by the said John Murray
be a
certain Bond or obligation from the said John MURRAY to the said
Alexander
Murray and bearing even date herewith without fraud or further delay
then these
presents and every matter clause and thing therein contained shall
cease, and
become absolutely void. And the said John Murray doth hereby for
himself his
heirs Executors administrators, and assigns covenant promise and grant
to and with
the said Alexander Murray his heirs Executors administrators and
assigns that
he the said John Murray his executors and administrators shall and will
well and
truly pay or cause to be paid unto the said Alexander Murray his
executors
administrators or assigns the said sum of Eighty five Pounds of Iawful
money of
Noviascotia with lawful Interest for the same on the day and at the
time hereinbefore
and also in the said Bond or obligation limited and appointed for
payment thereof.
And also that he the said John Murray hath good right full power and
lawful authority
to grant sell and convey the said Lot piece or parcel of Land with the
Appurtenances in manner and form as the same are herein and herby
granted sold,
and conveyed, and that if default shall happen to be made in payment of
the said
sum of Eighty five Pounds in manner aforesaid Then it shall be lawful
for the said
Alexander Murray his Executors Administrators, and assigns to enter
into have hold
use possess and enjoy the said Lot of Land and premises with the
appurtenances
without the Lawful let hindrance interruption or denial of
any person or persons
whomsoever. In Witness whereof the parties to these presents have
hereunto set
their hands, and seals the day and year first above and before written

foregoing Indenture from the therein named Alexander Murray Eighty
five pounds being the full consideration money therein mentioned
