WILL OF RODERICK McKENZIE

Last Will and Testament of Roderick McKenzie late of West River Regd. 315 ??? 28 Aug 1907 on the Certificate of John D. McLeod Regr.

In the name of God Amen I Roderick McKenzie of West River in the County of Pictou Province of Nova Scotia being of perfect mind and memory, thanks be given to God, therefore calling unto mind the mortality of the body knowing that it is appointed for all men once to die Do make and ordain this my last will and testament that is to say: Principally and first of all I give and recommend my soul to God who gave it and my body I recommend to the earth to be buried with decent Christian burial at the direction of Executor nothing doubting but at the general Ressurection I shall receive the same again by the mighty power of God, and as touching and wordly estate wherewith it hath pleased God to bless me in this life 1 give devise and bequeath the same as follows: -

First My Executor are directed to pay all just and lawfull debts out of the personal property.

Second All the balance of the personal property of any kind whatsoever to my wife, Georgiana Anderson McKenzie for her personal benefit and use. Should my said wife die before I do then the personal property shall form part of my estate to be disposed of by my Executor as hereinafter directed.

Third - I give devise and bequeath to Charles Murray Dawson of Truro in the County of Colchester and William Ross of Pleasant Valley in the County of Pictou, farmer, as Trustees and also in Trust as follows: - My farm all the real estate consisting of land and the buildings tenements contained thereon and ways of water privileges connected therewith, now possessed or may hereafter become possessed to be disposed of as follows: - First I wish a lot or parcel of land or ground containing one quarter of an acre more or less at present used as a burying gound for the dead to be resumed forever for that purposed free of any charge for all neighbours and others who have formerly used the same or had lots therein.

Second - My wife Georgiana Anderson McKenzie to have full use and control for her benefit of all the balance of my real estate during her lifetime. I also authorize my said trustees with the consent in writing of my said wife Georgiana Anderson McKenzie to sell any portion or all of the real estate and pay the proceeds to my wife Georgiana A. McKenzie. Should the real estate no be sold at the time of the death of my wife Georgiana A. McKenzie my trustees aforesaid are directed to convert the same into money. I direct my Executors to have a suitable monument erected to the memory of myself and my beloved wife Georgiana Anderson McKenzie. I direct my Executors as a first charge on my estate to pay Lydia Ann Anderson the sum of Five Hundred dollars $500.00. My Executors to have power to pay this in such amounts and at such times as they may deem best. To Mary A. Fraser of Fall River, Mass,. the sum of One hundred dollars. To Mrs. Jessie Sutherland of East Earltown Colchester Co. the sum of One hundred dollars. It is my wish that the furniture and personal effects in the house be not sold but disposed of among my friends according to the direction I may give. Should my Estate realize more than sufficient to pay the bequests promised mentioned, I direct that the balance be divided into two equal shares. One share to be paid to the Trustee of St. Luke's Church, Saltsprings and one share to St. Luke's Auxiliary of Women's Foreign Missionary Society of the Presbyterian Church. The bequests to my wife Georgiana A. McKenzie are in lieu of dower in my estate.

I do hereby utterly disallow revoke and disannul all and every former will, testament, legacies, bequests and exaction by me in anyway before named willed or bequested in ratifying and confirming this and no other to be my last will and testament. I do hereby nominate and appoint the said Charles Murray Dawson of Truro and William Ross of Pleasant Valley in the County of Pictou as joint Executors of this my last will and testament.

In witness whereof I have sined sealed published and declared this instrument as my last will at West River this twenty eighth day of August 1906.
